Terms of Service

Effective starting: June 1, 2022

These LeanRecord Terms of Service (these “Terms”) describe your rights and responsibilities as a customer of LeanRecord.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following conditions shall have the same meaning regardless of whether they appear in singular or in plural.


 Definitions 

  • “LeanRecord”, “We”, “Us”means the software-as-a-service solution (including the corresponding mobile, desktop or other application(s)) currently branded as “LeanRecord”.
  • “You”means the entity you represent in accepting these Terms or, if that does not apply, you individually. If you are accepting on behalf of your employer or another entity, you represent and warrant that: (i) you have full legal authority to bind your employer or such entity to these Terms; (ii) you have read and understand these Terms; and (iii) you agree to these Terms on behalf of the party that you represent. If you don’t have the legal authority to bind your employer or the applicable entity please do not click “I agree” (or similar button or checkbox) that is presented to you. PLEASE NOTE THAT IF YOU CREATE A ORGANIZATION OR ARE LISTED AS AN ADMINISTRATOR FOR A ORGANIZATION, AND YOU USE AN EMAIL ADDRESS OWNED OR CONTROLLED BY YOUR EMPLOYER OR ANOTHER ENTITY AS YOUR PRIMARY OR SOLE EMAIL ADDRESS FOR THAT ACCOUNT, THEN (X) YOU WILL BE DEEMED TO HAVE REPRESENTED SUCH PARTY, (Y) YOUR CLICK TO ACCEPT WILL BE DEEMED TO HAVE BOUND YOUR EMPLOYER OR THAT ENTITY TO THE TERMS AND CONDITIONS, AND (Z) THE WORD “YOU” IN THE TERMS AND CONDITIONS WILL REFER TO YOUR EMPLOYER OR THAT ENTITY. 
  • “Organization” means the set of data you use, when working with LeanRecord. Within such an organization you might enter department titles, instruction data (e.g. work instructions, safety instructions related to your place of work) and co-worker data (e.g. names, need for trainings).

Terms

  1. Privacy and Membership Settings. LeanRecord lets you work collaboratively and get more done. LeanRecord’s features enable you to organize and document your training records in an efficient way. Through LeanRecord, you and your End Users, as applicable, are responsible for all data you enter and files you upload. This includes names and other data related to trainees and trainers (your co-workers), who don’t use an own account and who you document training records with. You are responsible to only enter data related to trainees and trainers, that have given their consent to you to do so. You are also responsible to delete data of such co-workers that should not be saved in your Organization anymore (e.g. in the event of a co-worker leaving your company).

  2. Public Information. No information processed with LeanRecord is publicly available.
    • All content of the database is restricted to authorized users of your Organization.
    • All files that you upload to the cloud storage or generate by using LeanRecord is secured by a long-lived download token.
    • We have no liability for how others may access or use Your Data as a result of privacy and membership settings or your or your End Users’ decision. If you or your end users invite a person to collaborate and join your Organization, that person will get access to the data stored in your Organization.
  3. Free Accounts on LeanRecord. For clarity, the Subscription Term for free LeanRecord accounts continues until the applicable account is terminated. Free LeanRecord accounts are No-Charge Products.
  4. Account Activity. In the event of termination of your account, we will delete all data, that was associated with your account. The data stored for your Organization will also be deleted at the same time, if there is no other user associated with your Organization anymore. We are not responsible for any data loss, that is related to the termination of your account. You acknowledge that we reserve the right to delete your account due to inactivity if
    • you are using LeanRecord on a free plan and you are not attached to an organization with paid subscription and
    • You have not been using LeanRecord for a period of at least 3 month and
    • You have not reacted on an email notification, that informed you about the planned deletion of your account.
  5. Security. Information about our security practices is described in our Privacy Policy in the section ‘Retention of your personal data’.
  6. Technical support. You may request technical help by writing to mail@leanrecord.com . The response time depends on total number of requests by all users as well as the availability of support personal and therefor isn’t defined or guaranteed.
  7. Free and paid plans. The free plan allows you to use LeanRecord with all its features, but the number of trainees is restricted. Accordingly, the paid plans allow to use LeanRecord with larger teams. Paid plans require the purchase of yearly licenses. There is only a single license required for each organization. When the paid period ends and You decide not to purchase a new license at that time, Your use of LeanRecord is restricted to the free plan, but Your data is not deleted.
  8. Indemnity. You acknowledge, that LeanRecord is not responsible for any damage that results from Your use of LeanRecord, in particular but not limited to loss of data.
